2. Description of Services

Maudhui Kidigitali Co. Ltd. provides a platform (Mnembo) that serves as a suite of AI and digital tools, and as a backend-as-a-service, enabling developers to build and operate applications. We also develop and operate our own proprietary applications using these same Services.

3. User Accounts
  • Registration: To access certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.
  • Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
  • Eligibility: You must be at least 13 years old to use the Services. If you are accepting these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to do so.

LTD., ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING THIRD-PARTY APPLICATIONS; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.

9. Indemnification

You agree to defend, indemnify, and hold harmless Maudhui Kidigitali Co. Ltd. and its employees, officers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the United Republic of Tanzania, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.
